LICENSES/PERMISSIONS   GENERAL INFORMATION

A license is the right granted to a physical or legal person by an administrative body under an administrative act to carry out a specific type of activity for an indefinite period of time which meets the conditions laid down by law.

A permit is the right granted to a physical or legal person by an administrative body under an administrative act to carry out a specific type of activity which meets the conditions laid down by law.  A permit is issued for performing a single action or multiple activities for a certain period of time.

An applicant seeking a license/permit for nuclear and radiation activity shall submit an application to the Agency of Nuclear and Radiation Safety. The application shall meet the requirements provided by the Law of Georgia on Nuclear and Radiation Safety and the Law of Georgia on Licenses and Permits. After reviewing the application documents the Agency makes decision to issue or refuse a license/permit.  

Application documents necessary to obtain a license to operate:

According to the Law of Georgia on Licenses and Permits (chapter III, article 9):
 
  1. An applicant for a license to operate shall apply to the license issuer in writing (It shall specify the type of the license to operate requested by the applicant, and shall include a list of attached documents);
  2. Legal entities under private law and individual entrepreneurs shall attach extracts from State Register to the application;
  3. The document evidencing payment of a license fee.
According to the Law of Georgia on Nuclear and Radiation Safety (chapter IV, article 17):
 
  1. Data (description of a specific type of activity, details on the source of ionizing radiation and its location, information on the person responsible for radiation safety, information on waste and its handling);
  2. Radiation protection program that, taking into consideration the source category, potential risk, and type of activity, defines the conditions and methods of adhering to the core principles of radiation safety, specifications of the equipment and/or source, as well as physical security (protection) conditions;
  3. List of workers and the documents certifying their qualifications and expertise;
  4. Recorded data on medical examination of workers;
  5. Schedule for import and export of radioactive sources to and from the territory of Georgia;
  6. In case of licensing of the activity of a foreign company in Georgia, in addition to the above mentioned, the following shall be appended to the application for a license:
 
A copy of the contract or project for performing a specific activity on the territory of Georgia;
A letter of guarantee by the company on exporting the imported radioactive sources after completing the activity, containing the indication of the date of export.
 
  1. In case of licensing a high radiation risk activity, a nuclear and radiation safety assessment, containing a radiation protection program and a decommissioning (or, facility closedown, depending on the type of activity) plan, shall be submitted instead of a radiation protection program.
Application documents necessary to obtain a permit to operate:

According to the Law of Georgia on Licenses and Permits (chapter VII, article 25):
 
  1. To obtain a permit, a permit applicant shall submit a written application letter to the permit issuer;
  2. Legal entities under private law and individual entrepreneurs shall attach to the application extracts from the state register;
  3. The document evidencing payment of a permit fee.
